Privacy policy

1. Purpose 

As part of the use of the website www.ledvard-sport.com, the LEDVARD company processes personal data.

The purpose of this privacy policy is to define the rules for collecting and processing personal data of Internet users who contact the company LEDVARD via the form provided on the website www.ledvard-sport.com, individuals who subscribe to the newsletter, and customers of the company LEDVARD.

It has been drawn up in accordance with the provisions of Law n°78-17 of January 6, 1978 (known as the “Loi informatique et libertés”) and the General Regulation on the Protection ofPersonal Data (hereinafter the “RGPD”) n°2016/679. It is displayed and available on the website www.ledvard-sport.com.

The data controller is LEDVARD, a simplified joint stock company with share capital of €30,000, headquartered at 83 Impasse de la Fruitière – 74350 Allonzier-la-Caille, registered with the Thonon Trade and Companies Register under RCS THONON 951 566 710, intra-community VAT no. 4. Definitions 

“Subscribers”: refers to natural persons subscribing to the LEDVARD newsletter, it being specified that a Subscriber may also be a Customer or Prospect.

“Customers”: refers to natural persons who have placed an order with the company LEDVARD on the Site.

“Data”: refers to the personal data of Prospects and Customers, within the meaning of Article 4 of the RGPD.

“Prospects”: refers to individuals who have contacted the company LEDVARD using the form provided on the website www.ledvard -sport .com.

“Site”: refers to the website www.ledvard -sport .com

“Users”: refers to Subscribers, Customers and/or Prospects.

5. Persons concerned 

The persons concerned by the processing are the Site Users, whether they are Subscribers, Prospects or Customers.

6. Data typology

The data collected is that which is necessary for the proper operation of the Site.

For Subscribers, this will be an e-mail address only, unless the Subscriber is also a Customer or Prospect.

Prospects may include :

– other information voluntarily disclosed by the User

In the case of customers, this may include :

7. Data collection method

Subscriber Data is collected when subscribing to the LEDVARD newsletter.

Prospects’ Data are collected :

– At the time of sending the contact form available on the Site previously filled or during events organized by the Company;

– At the time of pre-booking products on the Site ;

– Passively, notably through the use of cookies.

Customer Data is collected when the customer :

– Create an account on the Site;

– Logs into his account via a connection terminal ;

– Place your order on the Site;

– Passively, notably through the use of cookies.

8. Purposes of data collection

The Data collected enables us to respond to the User’s requests. The Data is thus necessary for :

– manage, process and track technical or commercial requests from the User;

– facilitate your requests ;

– find the history of your requests and the information you have received;

– provide assistance to the User;

– ensure Site security;

– manage a list of opposition, access, rectification to the processing of Data ;

– compile and manage files of Site Users;

LEDVARD also processes Customer Data for the purposes of :

– manage customer invoicing and collection where appropriate;

– manage customer accounts.

In the case of Subscribers, the Data collected will be used for the sole purpose of managing and sending the newsletter, unless the Subscriber is also a Customer or Prospect.

Where the User has given his prior consent, Data concerning him may be processed for the purposes of :

– send news, information and personalized requests by e-mail

– Marketing with or without personalization

– Transfer the Data to a partner for commercial prospecting purposes

9. Legal basis

The processing of personal data via the Site is based on the following legal grounds:

– the express consent of the User when such consent is mandatory,

– the contract concluded between LEDVARD and the Customer, formalized on the basis of these General Terms and Conditions of Sale, which the Customer will have accepted prior to placing any order on the Site,

– the need for LEDVARD to comply with its legal, tax and social obligations,

– the company’s legitimate interests LEDVARD.

10. Recipients

As part of the Site’s operation, the Data collected may be transmitted to various recipients, subject to the User’s express prior consent when transferred for commercial prospecting purposes.

11. Subcontractors

Insofar as it is necessary for the purposes set out above, the data collected may be transmitted to the company’s service providers LEDVARD (IT service providers, hosting companies, logistics service providers, etc.) in order to respond favorably to the User’s requests, to ensure the proper execution and delivery of orders, to issue and manage invoices, and to carry out mailing and marketing activities, in particular prize draws for competitions.

No data is transferred outside the European Union.

12. Data retention period

Data is kept for no longer than is necessary for the purposes for which it is recorded.

More specifically, the Data is kept :

– For the management of User accounts: 3 years from the date of collection or the last click by the User;

– For the management of orders placed on the Site: the time of the contractual relationship and the time of prescription of the responsibility of the company LEDVARD ;

– For customer billing and collection management: 10 years;

– For accounting and, in particular, customer account management: 10 years;

– For the creation and management of customer files: for the duration of the contractual relationship, then for 3 years for commercial prospecting purposes from the date of collection or last contact by the customer;

– For the creation and management of prospect files: 3 years from the date of collection;

– For the management of an opposition list: 3 years from registration on the list;

– For marketing actions with or without personalization: 3 years from registration on the list;

– For the sending and management of the newsletter: as long as the Subscriber has not requested unsubscription;

– For statistical analyses: 3 years from the date of collection;

– For protection against fraud and potentially prohibited or illicit activities: 3 years from the last connection;

– For the management of the exercise of the right of access or rectification by Users (identity documents): 1 year.

13. Data security

LEDVARD pays particular attention to protecting User Data against any form of damage, loss, misappropriation, intrusion, disclosure, alteration or destruction.

This vigilance is carried out :

– by the use of cryptographic means in the transmission of Data (SSL);

– with regular data backups.

14. Cookie policy

The User is hereby informed that the following cookies are used by LEDVARD to operate the Site:

– The right to obtain a copy of your personal data;

– The right to request the rectification, updating, blocking or deletion of data concerning him/her, which may be inaccurate, erroneous, incomplete or obsolete;

– The right to data portability.

LEDVARD will endeavor to respond to any request for access, rectification or opposition or any other request for additional information made by any person concerned within a reasonable period of time, which may not exceed one (1) month from receipt of the request.
